 CITY OFFICES AND FILING INFORMATION - 2007 Municipal elections are OPEN and NONPARTISAN. That means, candidates’ political parties do not appear on the ballot. You must be a properly registered voter of the city of Las Vegas to vote in this election and you may vote regardless of your party affiliation.
Las Vegas City Charter provides that if, in the Primary City Election, one candidate for an office receives more than a majority of votes cast, they are declared elected and no General City Election is held. If no candidate for that office receives a majority of votes, the names of the two candidates receiving the highest number of votes are placed on the ballot for the General City Election.  Therefore, YOUR PRIMARY ELECTION VOTE IS VERY IMPORTANT!
The term of office for the Mayor and each council ward is four years. The 2001 Nevada State Legislature expanded the term of office for the city’s municipal judge positions from four to six years, which commenced in the 2003 election cycle.
The City's Primary Election will be held on Tuesday, April 3, 2007 and the General Election, if required, will be held on Tuesday, June 5, 2007. Offices for election are:
MAYOR – 4 Year Term Salary: $59,657 Incumbent: Oscar B. Goodman
COUNCILMAN WARD 1 – 4 Year Term Salary: $45,410 Incumbent: Lois Tarkanian
COUNCILMAN WARD 3 – 4 Year Term Salary: $45,410 Incumbent: Gary Reese
COUNCILMAN WARD 5 – 4 Year Term Salary: $45,410 Incumbent: Lawrence Weekly
MUNICIPAL JUDGE DEPARTMENT 6 - 2 Year Term Elected At Large Salary: $136,560 Incumbent: None
Filing Fee: $100.00 (cash, check, certified check or money order accepted)
When to File: January 23, 2007, 8 a.m. - Filing for office begins February 2, 2007, 5 p.m. - Filing for office closes

What to Bring: Identification by one of the following:
(1) a valid driver’s license or identification card issued by a governmental agency that contains a photograph of the candidate and the candidate’s address; or
(2) a current utility bill, bank statement, paycheck, or document issued by a governmental entity, including, without limitation, a check, which indicates the candidate’s name and address.   When filing for office, a complete filing packet will be provided. This packet will contain all forms, instructions and general information necessary to comply with the requirements of Las Vegas City Charter, Las Vegas Municipal Code, and Nevada Revised Statutes.
Using a nickname on the ballot: A nickname of not more than 10 letters may be used on the ballot; however, it must be in quotation marks and appear immediately before the candidate's surname. Other provisions apply under NRS 293.2565.
QUALIFICATIONS FOR OFFICE
Each candidate for MAYOR shall be a qualified elector* who has actually*, as opposed to constructively, resided within the boundaries of the city which he/she desires to represent for a period of not less than 30 days immediately prior to the last day for filing a Declaration of Candidacy. The mayor shall be elected by the registered voters of the city at large.
Each candidate for COUNCILMAN shall be a qualified elector* who has actually*, as opposed to constructively, resided within the ward which he/she desires to represent for a period of not less than 30 days immediately prior to the last day for filing a Declaration of Candidacy. Each city councilman shall be elected by the registered voters of the ward in which he/she is a candidate.
Each candidate for MUNICIPAL JUDGE shall be an attorney licensed to practice law in the State of Nevada, never been removed or retired from any judicial office by the Commission on Judicial Discipline and a qualified elector* who has actually*, as opposed to constructively, resided within the boundaries of the city for a period of not less than 30 days immediately prior to the last day for filing a Declaration of Candidacy. Each municipal judge shall be elected by the registered voters of the city at large.
*A qualified elector is a citizen of the United States, 18 years of age or older, who satisfied any residency requirement for this election and is not otherwise disqualified by reason of a treason or felony conviction or insanity, unless their civil rights have been restored by a court of competent jurisdiction.
Please note that if, upon receipt of credible evidence indicating that a candidate has been convicted of a felony and has not had his civil rights restored by a court of competent jurisdiction, filing officers may pursue removing the individual from the ballot (NRS 293C. 185).
*”Actual residence” is defined in NRS 281.050 as the place where a person is legally domiciled and maintains a permanent habitation. If the person maintains more than one such habitation, the place the person declares to be his or her principal permanent habitation when filing a declaration pursuant to NRS 293C.185 shall be deemed to be the person’s actual residence.
Provisions: If at 5 p.m. on the last day for filing a Declaration of Candidacy, there is only one candidate for any office, that candidate must be declared elected and no Primary or General City Election may be held for that office.
Elected officials shall qualify and enter upon the discharge of their respective duties on the day of the first regular meeting of the City Council next succeeding the meeting at which the canvass of the returns is made. (City Charter 5.100).

Election 2007 General Information

CARGOS DE LA CIUDAD E INFORMACIÓN PARA LA PRESENTACIÓN DE CANDIDATURA - 2007
Las elecciones municipales son ABIERTAS y NO PARTIDISTAS.  Esto quiere decir que los partidos políticos de los candidatos no aparecerán en la boleta electoral.  Ud. debe ser un votante debidamente registrado de la ciudad de Las Vegas para votar en esta elección, y Ud. puede votar sin importar su afiliación de partido.
La Carta Municipal de la Ciudad de Las Vegas estipula que si, en la Elección Primaria Municipal, un candidato recibe más de la mayoría de votos emitidos, es declarado electo y no se celebra Elección General Municipal.  Si ningún candidato para ese cargo recibe una mayoría de votos, los nombres de los dos candidatos con el mayor número de votos aparecerán en la boleta para la Elección General Municipal.  Por lo tanto, ¡SU VOTO EN LA ELECCIÓN PRIMARIA ES MUY IMPORTANTE!
 El mandato para el cargo de alcalde y de cada distrito concejal es de cuatro años.  La Legislatura del Estado de Nevada en el 2001 extendió el mandato para los cargos de los jueces municipales de cuatro a seis años, empezando con el ciclo electoral del 2003.
La Elección Primaria Municipal se llevará a cabo el martes, 3 de abril de 2007 y la Elección General, si es necesaria, se llevará a cabo el martes, 5 de junio de 2007.  Los puestos para elegir son los siguientes:

Qué Presentar: Documentos de identificación como:
(1) una licencia de manejar o tarjeta de identificación expedida por una entidad gubernamental que incluya una foto del candidato y el domicilio del candidato, o
(2) una factura actual de servicios públicos, un estado de cuenta bancaria, un cheque de pago, o un documento expedido por una entidad gubernamental, incluyendo, sin limitación, un cheque, que indique el nombre y el domicilio del candidato.  Al registrar una candidatura, se le proveerá un paquete de presentación.  Este paquete contiene todo los formulario, las instrucciones e información general necesaria para  cumplir con los requisitos de la Carta Municipal de la Ciudad de Las Vegas y las leyes del Estado de Nevada.
Uso de Apodos en la Boleta Electoral: Un apodo de no más de 10 letras se puede utilizar en la boleta; sin embargo, debe de aparecer entre comillas e inmediatamente después del apellido del candidato.  Otras provisiones están en vigor según la ley estatal NRS 293.2565.REQUISITOS PARA LOS CARGOS 
Cada candidato para ALCALDE debe ser un elector calificado* que ha tenido residencia real*, contrario a tener solo el domicilio, dentro de los límites de la ciudad de la cual él / ella desea representar, por un periodo no menor de 30 días inmediatamente antes del último día para presentar la Declaración para Candidatura.  El alcalde debe de ser elegido por los votantes registrados de la ciudad en general..
Cada candidato para CONCEJAL debe ser un elector calificado* que ha tenido residencia real*, contrario a tener solo el domicilio, en el distrito en el cual él / ella desea representar por un periodo no menor de 30 días inmediatamente antes del último día para presentar la Declaración para Candidatura. Cada concejal debe ser elegido por los votantes registrados del distrito en el cual él / ella es un candidato.
Cada candidato para JUEZ MUNICIPAL debe de ser un abogado con licencia para practicar la ley en el Estado de Nevada, nunca haber sido destituido o retirado de ningún cargo judicial por la Comisión de Disciplina Judicial y ser un elector calificado* que ha tenido residencia real*, contrario a tener solo el domicilio, dentro de los límites de la ciudad por un periodo de no menos de 30 días inmediatamente antes del último día para presentar la Declaración para Candidatura. Cada juez municipal debe de ser elegido por los votantes registrados de la ciudad en general.
* Un elector calificado es un ciudadano de los Estados Unidos, de 18 años de edad o mayor, que ha satisfecho cualquier requisito de residencia para esta elección y que además no sea descalificado por razones de traición, por condena de un delito mayor o por locura.
Por favor note que si al recibir evidencia creíble indicando que un candidato ha sido declarado culpable de un delito grave y no se le han restaurado sus derechos civiles por una orden judicial, los funcionarios de presentación pueden buscar la eliminación del individuo de la boleta (NRS 293C.185).
* “Residencia real” es definida en la Ley NRS 281.050 como el lugar en que una persona esta legalmente domiciliada y mantiene una habitación permanente.  Si la persona mantiene más de un lugar como habitación, el lugar que la persona declare ser suyo o su principal habitación permanente cuando entregue su declaración, según la Ley NRS 293C.185, será considerada como la residencia real de la persona.
Estipulaciones:
Si a las 5 p.m. del último día para presentar la Declaración para Candidatura, sólo hay un candidato para cualquier cargo, ese candidato debe de ser declarado como elegido y ninguna Elección Primaria o General de la Ciudad debe de llevarse a cabo para ese puesto.
Los oficiales elegidos deben satisfacer los requisitos y deben comenzar sus respectivas obligaciones el día de la primera junta regular del Consejo de la Ciudad, después de la reunión en la cual se lleva a cabo el escrutinio de los resultados electorales. (Carta constitucional de la Ciudad 5.100).

Nevada Revised Statutes sections 293C.3572, 293C.361 and 293.740 govern campaigning and electioneering. The rules differ for early voting and Election Day:   
Early Voting:  
<UL>
<LI>If the voting site is located on PRIVATE PROPERTY (mall, supermarket, etc.), electioneering is not allowed on the owner’s property without the owner’s permission (NRS 293C.3572). </LI>
<LI>If the voting site is located on PUBLIC PROPERTY, electioneering is not allowed within 100 feet of the voting area (NRS 293C.361). </LI></UL>
Election Day:    Electioneering is not allowed within 100 feet of the entrance to the building or structure in which a polling place is located (NRS 293.740).

Definition: NRS 293.740 defines electioneering as campaigning for or against a candidate, ballot question or political party by:

<LI>Distributing literature. </LI>

This statement is filed with the Secretary of State 10 days after the last day to file a declaration of candidacy (NRS 281.561). Forms will be provided in the candidate filing packet and the Secretary of State may be contacted directly for further details.

Candidates must complete and file this form with the Nevada Secretary of State on or before Monday, February 12, 2007.
If certified mail is used, the date of the postmark shall be deemed the date of filing; if mailed, this filing must be received in the Secretary of State’s office on or before February 12, 2007. 
We suggest you make two copies of your completed original form. Mail your original form to the Secretary of State by certified mail, return receipt requested, to provide you with mailing documentation for your records.  Retain a copy for your file.
Remember: A candidate for public office or public officer who fails to file a Financial Disclosure Statement in a timely manner pursuant to NRS 281.561 is subject to a civil penalty and payment of court costs and attorney’s fees. Contributions & Expenses / In Kind Reports 2007 In accordance with the Nevada Campaign Practices Act, every candidate for municipal office must file the required Contributions and Expenses Reports even though they withdraw their candidacy, have no opposition, lose in the Primary Election, their name does not appear on either the Primary or General Election ballot, they are elected to office, or they do not file a declaration of candidacy but are a candidate as defined in NRS 294A.005 because they have received campaign contributions in excess of $100. Who May Vote By Mail Any registered voter, for any reason, may request a mail ballot. The request must be in writing. First-time voters who did not provide I.D. when they registered must provide I.D. when they vote: If you did not provide identification when you registered and have not yet voted in a Clark County election:

What is Mail Ballot Voting? Mail ballots accommodate voters who cannot or do not wish to vote in person during early voting or on Election Day. After the request is processed, the voter will be sent mail ballot voting materials, which include an optical scan ballot, a sample ballot designed for mail ballot voting and instructions.

Where Mail Ballot Requests Are Available

<LI>Write Your Own Letter: The letter must include the following for each person in the household requesting a mail ballot:

Request for Absent Ballot The request must be received in the office of the City Clerk at 400 Stewart Avenue, Las Vegas, Nevada on or before the 5:00 p.m. on the Tuesday before Election Day. The specific deadlines are:
March 27, 2007: Last day to RECEIVE written mail ballot requests for the April 3, 2007 Municipal Primary Election. May 29, 2007: Last day to RECEIVE written mail ballot requests for the June 5, 2007 Municipal General Election. Returning your Voted Ballot Do NOT Drop off Your Voted Mail Ballot at an Early Voting or Election Day Polling Place: It will NOT be accepted. You may drop it off at the Las Vegas City Clerk’s office on or before 7 p.m. on Election Day. Please see contact information contained within the Voter Guide.

Voting In Person Instead Of By Mail If you requested a mail ballot, you still have the option of voting on an electronic voting machine at an early voting site or at your election day polling place. If you are in a mailing precinct, you may only do this at an early voting site, NOT at an election day polling place.
If You Have Your Mail Ballot Surrender your voted or unvoted mail ballot (in the packet sent to you) to an election official at the voting site. He/she will then process you to vote.
If You Do Not Have Your Mail Ballot  You will sign an affirmation at the voting site swearing that you have not already voted in the current election.  An election official will verify your affirmation against Election Department records.
DEADLINE: The Las Vegas City Clerk must receive your voted mail ballot (whether mailed or returned in person) on or before 7 p.m. ON ELECTION DAY in order for it to be counted.
Who May Return It Only the voter who requested the mail ballot or a family member may return it. If a family member returns it, that family member must sign a statement confirming he or she is a member of the voter’s family.
Persons with Disabilities  Registration Accommodations: If You Cannot Sign Your Name on Your Voter Registration Application: You must register and be identified in person at the Election Department. If you are unable to appear in person, you may request the Election Department send an election official to you.

Solicitud para una Boleta por Correo La solicitud se debe recibir en la oficina de la Secretaria de la Ciudad al 400 Stewart Avenue, Las Vegas, Nevada hasta las 5 p.m. del mártes antes del día de la elección.  Las fechas limites son:

Cómo Devolver su Boleta Votada NO Entregue Su Boleta Postal Votada en un Centro de Votación:  Conforme a la ley de Nevada, los centros de votación no pueden aceptar una boleta postal votada el día de la elección o durante la votación temprana.  Ud. puede llevarla a la oficina de la Secretaria de la Ciudad antes de las 7 p.m. el día de la elección.  Favor de consultar la información de contacto en esta guía.
La Votación en Persona en Vez de por Correo Si solicitó una boleta postal, Ud. aún tiene la opción de votar en una máquina electrónica de votación en un centro de votación temprana o en su centro de votación el día de la elección.  Si usted vive en un precinto postal, Ud. sólo puede hacer esto en un centro de votación temprana, NO en un centro de votación el día de la elección.
& Si Tiene Su Boleta Postal:  Entregue su boleta, votada o no (en el paquete en que se le envió), a un oficial electoral en el centro de votación.  El oficial tramitará lo necesario para que Ud. vote.

Fecha Limite  La Secretaria de la Ciudad de Las Vegas deben recibir su boleta votada (si la envía por correo o si la entrega en persona) para o antes de las 7 p.m. EL DÍA DE LA ELECCIÓN para que sea contada.
Quién Puede Entregar Su Boleta Postal Votada Sólo el votante quien solicitó la boleta postal o un miembro de la familia puede entregar la boleta postal votada.  Si la entrega un miembro de la familia, esa persona tendrá que firmar una declaración que es miembro de la familia del votante.
Personas con Discapacidades Si No Puede Firmar Su Nombre en Su Solicitud Para Inscribirse Como Votante:  Debe registrarse y ser identificado en persona en el Departamento de Elecciones.  Si no puede presentarse en persona, puede solicitar que el Departamento de Elecciones le mande un oficial electoral a usted.

Early Voting (Before Election Day) Period for Early Voting: Voters registered in the city of Las Vegas may vote at an early voting site beginning Saturday, 17 days before election day, through the Friday before the election (a total of 14 days). Early voting sites, hours and dates vary throughout the city. 
Early Voting Procedures: Before you are allowed to vote, an election official will verify your eligibility and signature using a computer connected to the Election Department’s centralized voter registration files. Your voter record will be updated immediately as part of your processing, thus preventing the possibility of an individual voting twice. Early voting results are reported after 7 p.m. on Election Day.

Early Voting Schedule

Votación Anticipada (Antes del Dia de las Elecciónes) Período de Votación Anticipada:  Votantes registrados en la Ciudad de Las Vegas pueden votar en un sitio de votación anticipada empezando el sábado, 17 días antes del día de las elecciones, hasta el viernes antes de dichas elecciones (un total de 14 días).  Sitios de votación anticipada, horarios y fechas varian por todo la ciudad.
Procedimientos Para Votar con Anticipo:  Antes de que se le permita votar, un oficial electoral verificará su elegibilidad y firma por medio de una computadora con conección al archivo centralizado de registros de votante del Departamento de Elecciones.  Su registro de votante estará puesto al corriente inmediatamente, de esta manera impidiendo la posibilidad que un individuo vote más de una vez.  Los resultados de la votación anticipada son reportdos después de las 7 p.m. el día de las elecciones.
Los horarios y fechas para la votación temprana varían por lugar.
