City of Las Vegas Business License Instructions
Advertising Specialties
An Advertising Specialties business sells, markets, or distributes goods, merchandise or services which are sold or otherwise distributed to persons who give away, sell or otherwise distribute them as advertising or as inducement for the purchase of other goods, merchandise or services. Advertising Specialties do not include goods, merchandise or services which are part of the product line of the person offering or selling them
- Confirm that the proposed business location is within the Las Vegas city limits and properly zoned for this activity. For information on planning, zoning, and building requirements, call (702) 229-6301or visit our Development Services Center at 731 South 4th Street.
- Make application for a Nevada sales/use tax permit and state business license from the Nevada Department of Taxation located at 555 East Washington Avenue, Las Vegas, Nevada 89101. For additional information call (702) 486-2300 or visit their website at http://tax.state.nv.us/.
- Obtain and provide to the city of Las Vegas a surety bond in the penal sum of $25,000. This bond must be conditioned to be paid to the city of Las Vegas or to any person who suffers any damage by reason of any misrepresentation or violation of the provisions of LVMC 6.07 by the licensee, his agents or employees. The bond must be approved by the City Attorney.
- Advertising specialty applicants must have a telemarketing license or proof of exemption from the Nevada Department of Business and Industry, Consumer Affairs Division in accordance with NRS 599B.020. Any exemption must be in writing. For more information contact the Consumer Affairs Division at (702) 486-7355. Consumer Affairs is located at 1850 East Sahara Avenue #120, Las Vegas, Nevada, 89104.
- In addition to the information required by Chapter 6.02 of this code, the applicant must provide to the director exact copies of the following: (1) all sales presentations used by the applicant and its solicitors (in written form), including, but not limited to, the initial sales, verifications and reorder sales presentations; (2) advertising bulletins, announcements, circulars, brochures and all other promotional materials used by the applicant and sent to purchasers to promote, sell or advertise premiums of any kind; (3) all contracts which set out the terms and conditions on which the seller or factor obtains premiums of any kind for subsequent distribution in connection with the sale of advertising specialties. The terms of oral contracts shall be reduced to written form to comply with this paragraph.
- If the licensee changes the materials described in item 5 of this list so as to alter the inducement to purchase advertising specialties or premiums, copies of all materials as changed must also be submitted to the director within ten days after such changes become effective.
- In addition to the information required by Chapter 6.02 of this code, an applicant for licensing as a seller must submit a list containing a principal, the business name and the business address of each factor and supplier of premiums with which it will do business. - Information which is submitted pursuant to this section shall be treated as confidential except as follows: (1) in the ordinary course of the administration of this chapter; (2) pursuant to subpoena or other order of a court of competent jurisdiction; (3) release to a duly authorized agent of any governmental agency acting pursuant to the agency's authority and function. - 30 days prior to commencing business, bring a completed license application and all applicable items listed above to the Business Services Division, 400 Stewart Avenue, 3rd Floor (City Hall).
- A $55.00 fee is due at the time the application is submitted. ($25.00 semiannual license fee + $30.00 processing fee). Make checks payable to CITY OF LAS VEGAS. (License fees are based on gross revenues and are due in advance semiannually. A pick-up fee may be required if your gross revenue is more than $12,000 the first 6 months).
- Business license applications are sent to the Planning Department and Fire Department for review and inspection. Upon approval from these agencies and completion of all items listed above, the Business Services Division will issue your business license.
