Distressed Merchandise Sale

Distressed merchandise sale means any offer to sell or any sale of merchandise of any kind on the implied or direct representation that such sale is in anticipation of the termination of a business at its present location or the forced moving of location of business or that the sale is being held under distress circumstances. 

1.      An application for a distressed merchandise sale permit may only be made by a person who holds a valid business license for the type of goods to be sold.  Make application at the City of Las Vegas, Business Services Division located at 400 Stewart Avenue 3rd Floor (City Hall).  Call (702) 229-6281 for additional information.

2.      Temporary signs or banners may require special permits from the Current Planning Division.  Call 229-6301 or visit that office at 731 S. 4th Street for more information.

3.      The application must be filed not less than fifteen days prior to the proposed sale.  The following information must be provided in the application for a distressed merchandise sale.

·        The name and address of the owner of the goods, wares or merchandise to be the object of the sale and if the sale is to be conducted by a person not the owner of the goods, then the name of the person conducting such sale;

·        A full and complete statement of the facts regarding the distressed merchandise sale, including the reason why such sale is being conducted and the proposed dates of the sale;

·        The means to be employed in advertising such sale, together with the content of any proposed advertisement;

·        An inventory of the goods, wares, and merchandise to be offered for sale shall be attached to and become a part of the required application;

·        The place where such stock was purchased or acquired and the terms and conditions of such acquisition and in the case of stock placed upon the premises within ninety days prior to such sale, the time of acquisition of such stock. 

4.      The permit shall specify the location at which the distressed merchandise sale is to be conducted and the period of time, specifying the dates thereof, for which the permit is granted.


5.      The permit for a distressed merchandise sale shall be issued for a period not to exceed thirty days.  However, the Director (for good cause) may extend said permit for an additional period not to exceed thirty days, providing the permittee has submitted with an application for renewal a revised inventory showing the items listed on the original inventory remaining unsold.

6.      Where the applicant operates more than one place of business the permit issued shall apply only to the one store or branch specified in the application and no other store or branch shall advertise or represent that it is cooperating with it, or in any way participating in the permitted sale, nor shall the store or branch conducting the sale advertise or represent that any other store or branch is cooperating with it or participating in any way in the permitted sale.

7.      Fees due with the application will total $180.00 ($150.00 permit fee + $30.00 processing fee).  Make checks payable to CITY OF LAS VEGAS.
